Managing Students Precluded From Attending School For Legal Reasons Procedure

This procedure has been developed to give the schools and staff information when considering an alternative 
placement or program for a student who is unable to attend their present school for legal reasons.

Where students are, by court order, or other reasons, to be precluded from attending their current school 
placement and, the student is not of school leaving age (18 years old), the following procedure should be 
followed:

1. When a court order / conditions/ or equivalent are issued, the student’s home school will complete a 
   Student Profile (Appendix A) on the student with input from some or all of the following: Principal, 
   Vice-principal, Guidance Counselor, School Based Support Person, Social Worker, SERT, Administrative Officer, teachers or others as required. From this profile an alternative placement or program is recommended. The options are prioritized to meet the needs of both the student and the system.
2. Based on the profile and Alternate Learning Plan a program is developed with a team composed of 
   Principals (or designates) from the present school and receiving school or program, Area Administrative Officer, Social Worker and other Board personnel as needed. Decision(s) for an alternate placement(s) or program(s) will be recommended (i.e. Grove School). The Administrative Officer will co-ordinate the meeting.
3. The Individual Improvement Plan and decision(s) recommending an alternate placement(s) or 
   program(s) are presented to the parents/guardians of the student for their input. Their approval and 
   support is desired and beneficial for the success of any option chosen for the student. In some cases, 
   there may be only one option. 
4. The final placement decision is the responsibility of the area superintendent(s) involved.
